1. Introduction
Welcome to Skratchr ("we", "us", "our"). Skratchr is a social golf platform and mobile application operated by Skratchr Ltd, a company registered in England and Wales.
These Terms govern your use of Skratchr's website, mobile applications, and services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use Skratchr.
2. Eligibility
- You must be at least 16 years old to register. If you are under 18, you must have consent from a parent or guardian.
- You confirm that the information you provide when creating an account is accurate, complete, and current.
3. Accounts and Registration
- You are responsible for maintaining the confidentiality of your login details.
- You are responsible for all activity on your account.
- You must notify us immediately of unauthorised use or breach of security.
We reserve the right to suspend or terminate accounts that breach these Terms, contain false information, or are used for abusive or fraudulent purposes.
4. Use of the Service
You agree to use Skratchr in accordance with applicable law and these Terms.
You may not:
- Post content that is offensive, defamatory, unlawful, or discriminatory.
- Misrepresent your handicap, playing statistics, or achievements.
- Interfere with the operation of Skratchr or reverse-engineer its software.
- Use Skratchr for commercial solicitation or spamming.
We may remove or disable content that violates these Terms or is deemed inappropriate.
5. Content Ownership and Licensing
a. User Content
You retain ownership of the content you create and upload (e.g. posts, scores, comments, photos).
By submitting content, you grant Skratchr Ltd a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and promote your content within the app, on our website, or in marketing materials.
b. Skratchr Content
All other intellectual property—including logos, trademarks, designs, badges, software code, and documentation—is owned by Skratchr Ltd or its licensors.
You may not copy, modify, distribute, or commercially exploit Skratchr content without our written consent.
6. Partner and Third-Party Integrations
Skratchr may connect with or display data from third parties including:
- Golf data systems such as the World Handicap System (WHS), My England Golf, iGolf, and other regional handicap authorities;
- Partner golf clubs, brands, or sponsors for events, badges, or rewards;
- Analytics and cloud service providers (for hosting, security, and performance).
Where integrations require your personal data, you will be asked to provide explicit consent.
Skratchr is not responsible for third-party services or data accuracy once data leaves our control.
7. Paid Partnerships and Advertising
Skratchr may display partner offers, branded challenges, or sponsored content.
- Sponsored or promotional content will always be clearly marked.
- Participation in paid or promotional activities is optional.
- Skratchr does not endorse any third-party goods or services displayed on the platform.
We may receive commission or affiliate income from promoted content or links.
8. Competitions, Challenges, and Rewards
From time to time, Skratchr may host in-app challenges or competitions ("Events").
- Participation may be subject to additional event-specific terms.
- Prizes or rewards are non-transferable and may not be redeemed for cash unless otherwise stated.
9. Liability and Disclaimer
Skratchr is provided "as is" and "as available", without warranty of any kind.
We do not guarantee uninterrupted access, accuracy of data, or compatibility with all devices.
To the fullest extent permitted by law, Skratchr Ltd is not liable for:
- Loss of data, revenue, or profits;
- Errors in score or handicap information;
- Unauthorised access to user accounts;
- Any indirect or consequential damages.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under UK law.
10. Termination
You may delete your account at any time through the app or by contacting support@skratchr.com.
We may suspend or terminate your account for:
- Breach of these Terms;
- Misuse or fraudulent activity;
- Legal or operational reasons.
Upon termination, your right to use Skratchr ceases immediately.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Amendments
We may revise these Terms periodically. Material changes will be communicated via the app or by email. Continued use after such changes constitutes acceptance of the new Terms.
