1. About Skratchr

Skratchr is a social golf platform built for golfers who want to find other golfers, form groups called Tribes, track rounds and achievements, discover golf courses, and be part of a golf community. Skratchr is operated by Skratchr Ltd, a company registered in England and Wales.

By accessing or using the Skratchr app, website or any related services, you confirm that you have read, understood and agree to these Terms of Use and our Privacy & Data Policy.

2. Eligibility

Skratchr is intended for users who are at least 18 years of age. By registering for an account you confirm that you are 18 or over. We may suspend or remove accounts where we believe this requirement has not been met.

3. Account Registration

To access many features of Skratchr you must register for an account. You agree to provide accurate, complete and current information during registration and to update this information if it changes. You are responsible for keeping your account credentials secure and for all activity that takes place under your account. You must notify us immediately if you believe your account has been compromised.

4. Your Content

Skratchr allows users to create, share, post and upload content including photos, scores, comments, messages, profile content and other golf-related material ("User Content"). You retain ownership of the content you create. By sharing content on Skratchr, you grant Skratchr a worldwide, non-exclusive, royalty-free, sublicensable, perpetual licence to use, host, store, reproduce, adapt, modify, distribute, publicly display and otherwise make available your User Content for the purpose of operating, improving and promoting Skratchr.

You confirm that you have the right to share any content you post and that it does not infringe any third-party rights.

5. Acceptable Use

When using Skratchr you agree not to:

• Post content that is harmful, abusive, harassing, threatening, discriminatory, obscene, defamatory or offensive;
• Impersonate any person or entity or misrepresent your identity;
• Post false, inaccurate or misleading information;
• Violate any applicable law, regulation or third-party rights;
• Share content that infringes copyright, trademark or any other intellectual property rights;
• Transmit spam, unsolicited messages or any form of bulk communication;
• Upload or transmit malicious code, viruses or any software designed to interfere with systems;
• Attempt to access, scrape or harvest data from Skratchr without authorisation;
• Circumvent, disable or interfere with security features, authentication systems or access controls;
• Use Skratchr to facilitate or promote any illegal activity;
• Use Skratchr for commercial advertising, solicitation or promotion without our prior written consent.

We reserve the right to remove content that violates these standards and to suspend or permanently ban accounts where necessary.

6. Golf Data, Scores and Integrations

Skratchr may allow users to log golf scores, record rounds and connect with external golf systems. You are responsible for the accuracy of data you enter. We do not guarantee the accuracy of any golf handicap, score or related data displayed through Skratchr. Where integrations with external golf systems or databases are available, your use of those integrations may be subject to the terms of those third-party providers.

7. Tribes and Groups

Skratchr allows users to create and join Tribes. You are responsible for any Tribe you create, including managing members and ensuring content within your Tribe meets these Terms of Use and our Acceptable Use standards. Skratchr reserves the right to remove or dissolve any Tribe that violates these terms.

8. Intellectual Property

All intellectual property rights in the Skratchr app, website, brand, design, technology, software and original content (excluding User Content) belong to Skratchr Ltd or its licensors. You must not copy, reproduce, distribute, modify or create derivative works from any part of Skratchr without our express written permission.

9. Privacy

Your use of Skratchr is governed by our Privacy & Data Policy, which is incorporated into these Terms of Use by reference.

10. Subscriptions and Payments

Skratchr may offer free and paid subscription tiers. Where a paid subscription applies, pricing, billing frequency, payment methods, cancellation terms and refund policies will be set out in the app at the time of purchase or subscription. Payments may be processed through the Apple App Store, Google Play Store or other payment providers. Refunds are subject to the relevant store or payment provider's policies.

11. Suspension and Termination

Skratchr reserves the right to suspend or terminate your account at any time, with or without notice, if you breach these Terms of Use, engage in prohibited conduct, create legal or security risk, or for any other reason at our discretion. You may close your account at any time by using the account deletion feature within the app or by contacting us at connect@skratchr.com.

12. Third-Party Links and Integrations

Skratchr may contain links to third-party websites, services, golf clubs, sponsors or other platforms. We are not responsible for the content, privacy practices or terms of third-party services. Links do not imply endorsement.

13. Disclaimers

Skratchr is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee that Skratchr will be uninterrupted, error-free or completely secure. We are not responsible for inaccuracies in user-submitted golf data, scores, handicaps or any third-party content. Golf is an outdoor physical activity. Skratchr is not a safety, navigation or emergency service and should not be relied upon in situations involving risk to life or physical safety.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Skratchr Ltd and its officers, employees, agents and partners will not be liable for indirect, incidental, special, consequential, punitive or exemplary damages arising from or in connection with your use of Skratchr. Where liability cannot be excluded, our total liability will not exceed the amount you paid to use Skratchr in the 12 months preceding the claim, or £100 if no amount has been paid.

15. Indemnity

You agree to indemnify and hold harmless Skratchr Ltd and its officers, directors, employees and agents from any claims, losses, damages, costs and expenses (including reasonable legal fees) arising from your use of Skratchr, your User Content, or your breach of these Terms of Use.

16. Modifications to These Terms

We may update these Terms of Use from time to time. Where changes are material we will notify you through the app, by email or by another appropriate method. Your continued use of Skratchr after the updated terms take effect means you accept the revised terms. If you do not agree with the changes, you may close your account.

17. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
